1. Acceptance of Terms
By downloading, installing, accessing, or using a Borrowed Fire product, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the product.
Borrowed Fire is the founder-led app company I use to publish the products I build.
These Terms apply to the public products currently listed on borrowedfire.com: Fated Pages, Jurni, and NextCatch. They do not apply to unpublished experiments, internal tools, or work-in-progress products unless those products are made public and linked to these Terms.
Some products may also have product-specific terms or policies. If a product-specific term conflicts with these Terms, the more specific product term controls for that product.
2. Description of Services
I publish focused software products through Borrowed Fire LLC for specific jobs:
- Fated Pages: a romantasy recommendation product with personalized book matching, saved-book surfaces, and book-discovery links.
- Jurni: a trip planner for organizing itineraries, expenses, documents, decisions, and shared trip details.
- NextCatch: a Pokemon GO raids and events app with event listings, planning tools, verdicts, reminders, and optional raid-room coordination.
Features may vary by product, platform, region, release version, account state, and subscription status.
3. Eligibility
You must be at least 13 years of age to use these products. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
4. Accounts and Access
Some features do not require an account. Other features do. For example, Fated Pages app access after onboarding requires Sign in with Apple and an active subscription, Jurni sharing and sync features may require Sign in with Apple, and NextCatch raid rooms require a free account and trainer profile.
You are responsible for keeping your Apple ID, Google account, app store account, and product account secure. You are also responsible for the accuracy of information you provide, including trip details, reader preferences, trainer profile information, support requests, and raid feedback.
5. Subscription Services
5.1 Subscription Terms
Some products may offer paid features or subscriptions, and some app experiences may require a subscription after onboarding. Subscriptions are billed through the platform where you purchased them, such as Apple's App Store or Google Play, and are subject to that platform's terms and conditions.
5.2 Billing and Renewal
- Auto-renewable subscriptions renew unless canceled before the end of the current billing period
- Your platform account will be charged according to the price, billing period, and renewal terms shown at purchase
- You can manage and cancel subscriptions in your App Store or Google Play account settings
- Restore Purchases may be available in the app where supported
5.3 Refunds
Refund requests are handled by the platform where the purchase was made, in accordance with that platform's refund policies.
6. User Content and Shared Features
You retain ownership of content you create or provide in the products, such as trip details, documents, expenses, polls, reader preferences, trainer profile details, raid feedback, and support messages.
When you share content with other people through a product feature, you give those people access according to the sharing settings and product behavior. For example, Jurni trip members may be able to view or edit shared trip content, and NextCatch raid-room participants may see trainer and raid coordination details needed to run the room.
You are responsible for content you add, share, submit, or confirm through the products.
7. User Conduct
You agree not to:
- Use the products for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the products
- Remove or alter any proprietary notices or labels
- Use the products in any way that could damage, disable, overload, or impair their functionality
- Abuse shared features, raid-room features, support forms, account features, or notification systems
- Provide false or misleading trainer profile information, trip information, support information, or raid feedback
- Harass, threaten, impersonate, or deliberately disrupt other users
- Violate any applicable local, state, national, or international law
- Use the products in a way that violates applicable third-party platform or game terms
8. Intellectual Property
8.1 Borrowed Fire Content
All content, features, design, branding, and functionality of the products, excluding your user content and third-party content, are owned by Borrowed Fire LLC and are protected by intellectual property laws.
8.2 Third-Party Content and Trademarks
The products may display, reference, or link to third-party content, data, names, trademarks, or services. All third-party marks are the property of their respective owners. Borrowed Fire does not claim ownership of any third-party intellectual property.
NextCatch is an independent fan-made app. It is not affiliated with, endorsed by, or sponsored by Niantic, The Pokemon Company, or Nintendo.
Fated Pages may reference book titles, author names, publisher metadata, and retailer links. Those belong to their respective owners.
9. Disclaimers
9.1 Information Accuracy
Information provided by the products is for general informational and planning purposes. I make reasonable efforts to keep product information useful, but I cannot guarantee that all information is complete, current, or error-free.
9.2 Fated Pages
Book recommendations, book metadata, content descriptions, spice levels, warning surfaces, and retailer links are informational. Reader taste is personal. Check book details before purchase or reading if you have specific boundaries.
9.3 Jurni
Jurni is a planning tool. Verify flight times, train schedules, lodging details, restaurant details, document accuracy, expense calculations, and other travel information before relying on them.
9.4 NextCatch
Pokemon GO events, raid availability, bonuses, schedules, counters, CP values, ticket details, and game mechanics may change at any time. NextCatch may use third-party or official publisher information, but original publishers control the underlying event and game details.
Raid-room features help coordinate users but do not guarantee successful raids, invites, host behavior, remote pass availability, or Pokemon GO service availability.
9.5 No Warranty
The products are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access.
10. Limitation of Liability
To the maximum extent permitted by law, Borrowed Fire LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, data, documents, plans, or goodwill
- Service interruptions, sync delays, or downtime
- Errors or inaccuracies in content
- Missed trips, reservations, events, raids, invites, purchases, or reading choices
- Any other intangible losses
Borrowed Fire LLC's total liability for any claims arising from your use of the products shall not exceed the amount you paid for the applicable product or subscription in the 12 months preceding the claim, or $50 USD, whichever is greater.
11. External Links and Purchases
The products may contain links to third-party websites or services. I am not responsible for the content, privacy practices, terms, availability, or accuracy of third-party sites.
Fated Pages may open book-search links outside the app, including Amazon or Apple Books. Fated Pages does not sell books in the app and does not use affiliate links for those book-search links.
For ticketed events, app stores, book retailers, or other external purchases, all purchases are conducted through the relevant third party and subject to that third party's terms.
12. Privacy
Your use of the products is also governed by the Privacy Policy. By using the products, you consent to the practices described in the Privacy Policy.
13. Modifications
13.1 To the Products
I may modify, suspend, or discontinue any product or feature at any time without prior notice.
13.2 To These Terms
I may update these Terms from time to time. Material changes may be communicated through the product, through the website, or by updating this page. Your continued use after changes constitutes acceptance of the modified Terms.
14. Termination
I may discontinue a product or feature at any time. If you have an active subscription at the time of discontinuation, refund eligibility is handled according to the platform where the purchase was made.
I may suspend or terminate access if you misuse the products or violate these Terms.
15. Indemnification
You agree to hold harmless Borrowed Fire LLC and its affiliates from any claims, damages, losses, or expenses arising from your misuse of the products, violation of these Terms, or content you add, share, submit, or confirm through the products.
16. Dispute Resolution
16.1 Informal Resolution
Before filing any formal dispute, you agree to contact me first and attempt to resolve the matter informally for at least 30 days.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.
16.3 Jurisdiction
Any disputes arising from these Terms shall be resolved in the courts located in New York, New York, and you consent to the personal jurisdiction of such courts.
17. General Provisions
17.1 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.2 Waiver
Failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
17.3 Entire Agreement
These Terms, together with the Privacy Policy and any product-specific terms that apply, constitute the agreement between you and Borrowed Fire LLC regarding the products.
17.4 Assignment
You may not assign or transfer these Terms without Borrowed Fire LLC's prior written consent. Borrowed Fire LLC may assign its rights and obligations without restriction.
